EGMF recommendations on Market Surveillance and New Legislative Framework revision
The upcoming European Product Act provides an opportunity to adapt the regulatory framework to digitalisation, support the transition to a more circular economy, and address the growing impact of unfair competition from non-compliant products entering the EU market.
EGMF believes that these objectives can only be achieved if the future framework does not create new burdens while asking for effective enforcement.
EGMF calls for:
- A Digital Product Passport focused on essential compliance information, not additional administrative burdens.
- Stronger market surveillance through better enforcement, border controls, resources and coordination.
- Protection of confidential technical documentation and intellectual property.
- Greater legal certainty on concepts like refurbishment, remanufacturing and substantial modification.
- A gradual, proportionate and cost-effective implementation of new digital requirements.
The European Products Act can play a key role enhancing product safety, strengthening compliance, support innovation and ensure a level playing field for European manufacturers.
